What the fleeing driver was legally required to do

Two different statutes cover leaving. Where anyone is injured, the driver's obligations are extensive and criminal. Where only property was damaged, Vehicle Code section 20002 requires the driver to stop immediately at the nearest location that will not impede traffic or otherwise jeopardize safety. Documenting the departure itself, direction of travel, partial plate, vehicle color and body style, and any debris left at the scene, matters because that debris is often the only physical link to a vehicle later identified.

The evidence that expires first

Private video is the usual solution and the usual loss. Business and residential systems in the downtown grid, along the waterfront and in the Eastside commercial blocks commonly retain footage for a matter of days before overwriting. Vehicle paint transfer on the struck car is recoverable only until the repair is done. Windshield glass and plastic lamp fragments left on the pavement are swept. Where a partial plate exists, the responding agency can work with it, but that work needs to begin while patrol resources still associate the case with a fresh report.

Reporting, and why the timing is not optional

A written report within 24 hours is required under Vehicle Code section 20008 where anyone was injured or killed. The Department of Motor Vehicles report under section 16000 is due within 10 days on injury, death, or property damage above $1,000, and excludes crashes involving a government vehicle. Beyond the statutes, uninsured motorist coverage in California policies is written to require prompt notice and a sworn statement in hit-and-run situations, so the policy's own timetable runs in parallel with the statutory ones.

The coverage that stands in for the missing driver

Insurance Code section 11580.2 requires bodily injury liability policies issued or delivered in California to include coverage for what the insured is legally entitled to recover from the owner or operator of an uninsured vehicle, unless the named insured signed one of the specified written agreements deleting or reducing it. That means the answer to whether coverage exists is found in the declarations page and any signed endorsement, not in a phone conversation. Where the injured person was a passenger, more than one household policy may apply.

How the insurer has to handle it

An uninsured motorist claim is a claim against one's own carrier, and the claim-handling regulations still govern. Title 10, section 2695.5 requires a response to a claimant's communication within 15 calendar days and action on a claim within 15 calendar days of notice. The neighboring settlement-standards section requires acceptance or denial within 40 calendar days of proof of claim, written notice every 30 calendar days where more time is needed, a thorough and fair investigation, and payment tendered within 30 calendar days of an accepted claim. It also requires written notice of an applicable limitation period at least 60 days before it expires, shortened to 30 days for first-party uninsured motorist claimants, and inapplicable where the claimant is represented by counsel.

Where a public entity enters the picture

If a signal, a sight-obstructing feature or a roadway condition contributed, a separate and much shorter deadline applies. the presentation rule in Government Code section 911.2 allows six months from accrual for a personal injury claim against a public entity, and ties the presentation date for state-level claims to a $25 filing fee. Missing that window generally closes that avenue regardless of how strong the underlying facts were.
