A single night in a trauma unit can exhaust a minimum-limits policy before any question of lost income, surgery or future care is reached. Underinsured motorist coverage exists because the legislature accepted that outcome and left the remedy to the injured person's own contract. The coverage is created by Insurance Code section 11580.2, which builds uninsured and underinsured protection into bodily injury liability policies issued or delivered in this state unless a named insured signed one of the statute's specified written agreements deleting the coverage, restricting it to designated drivers, or reducing it to the financial responsibility floor.
The arithmetic is the part worth understanding before a claim is made. Under subdivision (p) of the same section, underinsured motorist coverage does not pay on top of what the at-fault driver's carrier paid; the available underinsured limit is reduced by the amount the injured person received from or on behalf of the at-fault party. A policyholder who bought a limit equal to the other driver's limit therefore has nothing left to claim after the liability payment. That is the single most common disappointment in these files, and it is a purchasing decision made years earlier rather than a claims decision made after the crash.
Two features of the local market widen it. First, the injured population includes a large share of out-of-area drivers: SBCAG reports that 38,500 Ventura County residents were destined for Santa Barbara County on a typical weekday in fall 2022, and that 43.7 percent of work trips ending in the city of Santa Barbara began outside it. Policies written elsewhere carry that state's minimums, which may be lower than California's. Second, medical costs on a serious file are driven by where care is delivered, and the county emergency medical services agency identifies Santa Barbara Cottage Hospital as the county's Level I adult and Level II pediatric trauma center, with Marian Regional Medical Center in Santa Maria designated Level III adult. Trauma activation, imaging and surgical admission produce numbers that clear a modest liability limit quickly.
These claims have a sequence. The liability claim against the at-fault driver comes first, because the underinsured claim cannot be measured until the amount recovered from that side is known. Settling with the liability carrier without regard to the underinsured provisions of one's own policy can compromise the second claim, since policies contain consent and subrogation-protection terms. Reading the actual policy language before signing a release is not a formality; it is the step that determines whether the second layer survives.
An underinsured motorist claim is a contract claim against one's own insurer, and the timetable is set by the policy rather than by the ordinary personal injury statute. The settlement-standards regulation of title 10, section 2695.7, obliges an insurer to send written notice of any applicable limitation period no later than 60 calendar days before it expires, with a shortened 30-day requirement for first-party uninsured motorist claimants, notice given immediately where the claim arrives inside that window, and no such duty where the claimant is represented by counsel. That notice provision is a safeguard, not a substitute for tracking the date independently.
The same regulation applies when the adversary is one's own insurer. It requires acceptance or denial within 40 calendar days after receipt of proof of claim, written explanation and further written status every 30 calendar days when more time is needed, a thorough and fair investigation, payment tendered within 30 calendar days of acceptance, and a prohibition on offers so low no reasonable person would accept them. It also bars conditioning payment on withdrawal of a complaint filed with the Department of Insurance, and prohibits denial based on an undocumented telephone conversation or interview.
Three sets of paper. The declarations pages and endorsements for every policy in the household, since limits and any signed reduction agreement live there. The complete medical and billing record, since the value of the claim above the liability limit has to be demonstrated rather than asserted. And proof of the amount recovered from the at-fault side, because the offset is computed from it. Wage and self-employment records belong in the same file where earnings are affected.
