Three versions turn up locally: no evidence of insurance at all, a carrier denying the policy was in force that day, and a real policy that looks small next to a surgery. All three send you to the same two documents, your declarations page and the endorsement behind it.
The Department of Insurance announced that beginning January 1, 2025, as policies came up for renewal through the year, minimum liability limits rose to $30,000 for injury or death of one person, $60,000 per accident, and $15,000 for property damage, up from $15,000, $30,000 and $5,000. The same page notes the California Low Cost Auto program was left where it was, at up to $10,000 per person, $20,000 per accident and $3,000 for property damage. Those are two very different ceilings on the same road. On your side, Insurance Code section 11580.2 requires uninsured motorist coverage in a bodily injury liability policy unless a named insured signed a written agreement deleting or reducing it. The section sets the amounts an insurer must offer at $30,000 and $60,000, and requires underinsured coverage to be offered at limits equal to the uninsured motorist limits already in the policy.
Read subdivision (p) slowly. It measures the other driver's policy against the uninsured motorist limit sitting on your own car and treats that vehicle as underinsured only when the other figure is the smaller one. Buy the same limit the at-fault driver bought and the gap is zero, whatever the hospital charged. Payment is sequenced too: nothing is owed on this coverage until every liability policy behind the vehicles that hurt you has paid out to its ceiling and the receipts have reached your carrier.
Three conditions apply, and geography decides one of them. Something has to have touched you or the car you rode in. Notice of the crash has to reach law enforcement inside 24 hours, and the correct office depends on where the wheels stopped: the municipal force for a crash inside city boundaries, otherwise the sheriff of that county or the nearest Highway Patrol headquarters. A sworn statement follows to the insurer inside 30 days, setting out the facts behind a claim against a person who cannot be named. Isla Vista sits in unincorporated territory, so a student struck on a street between the campus and downtown may owe that report to the sheriff or the CHP and not to city police. This is not a rare problem locally: the Office of Traffic Safety recorded 47 fatal and injury hit-and-run collisions in the city of Santa Barbara in 2023, ranking it 12th of 103 similar cities, and 197 across Santa Barbara County, ranking it 9th of 58 counties.
The same rankings put the city first out of 103 for bicyclist victims killed and injured, with 131 in one year, and put the county second out of 58 with 252. UCSB's bike committee reports that roughly 14,000 people ride to campus each day school is in session. A cyclist hands over no plate and often has no vehicle in the crash, yet may still be an insured person under a household auto policy, which is where the unknown-driver rules matter. Record the crossing, the direction of travel, the lighting, and any helmet or frame damage before the bike is thrown out.
Civil Code section 3333.4 bars noneconomic losses, meaning pain, suffering, inconvenience, impairment and disfigurement, where the injured person owned an uninsured vehicle in the crash, drove without being able to establish financial responsibility, or was convicted of driving under the influence. Medical bills and lost wages stay available. Subdivision (c) holds the exception people miss: an uninsured owner hurt by a driver convicted of driving under the influence keeps the noneconomic claim. Whether the statute bites at all turns on documents, not on assumptions made at the curb.
The same uninsured motorist statute excludes coverage for bodily injury where the insured, without the insurer's written consent, settles with or takes to judgment a person who may be legally liable. A small check from the other driver's carrier, endorsed and banked, can erase the coverage meant to carry the rest. A trigger sits alongside it. This coverage produces no cause of action at all unless one of three things happens inside two years of the collision date. A suit goes on file against the uninsured driver, the sum owed is fixed by agreement, or arbitration is opened formally by certified letter with a return receipt. Ask for consent in writing first, then decide about the liability payment.
The file opens with paper rather than narrative: the declarations page, the uninsured and underinsured limits, any signed reduction agreement, the endorsement's notice and consent terms, and the report showing which agency took the 24-hour notice. On fees, Rule 1.5 prohibits an unconscionable or illegal fee and supplies the thirteen factors for judging one, measured on the facts as they stood when the agreement was signed. Arbitration under the policy carries its own costs, which belong on a line separate from any share of a recovery.

Why it matters: A collision involving a UCSB or Isla Vista trip may require early investigation of a bicycle or scooter route, a campus-area witness, a borrowed vehicle, and applicable insurance documents instead of treating it as a generic roadway claim.
